Attorney General Fitch secures restraining order against GoodRx and affiliates over pharmacy reimbursements

Mississippi Attorney General Lynn Fitch announced Thursday that her office has secured a temporary restraining order against GoodRx, Inc.; GoodRx Holdings, Inc.; MS CVS Pharmacy, LLC; and Inside Rx, LLC, blocking them from enforcing discount card program reimbursements on pharmacies without consent.

The restraining order, issued by the Harrison County Chancery Court, halts practices that Fitch said violate Section 83-9-6.1 of the Mississippi Code. The state law protects independent pharmacies from being forced into reimbursement arrangements they did not agree to.

“For years, Mississippi’s independent pharmacies have been forced to take artificially low reimbursements because the PBMs have used their influence and leverage to effectively force non-negotiable contracts on them,” Fitch said in a statement. “These small business owners are already operating on razor-thin profit margins.”

Fitch said fees associated with discount card programs—particularly those involving GoodRx—can result in pharmacies losing money on prescriptions, driving closures and reducing access to care in rural areas.

“This is wrong. And it is against Mississippi law,” Fitch said. “Mississippi is fighting back and we achieved an important victory.”

Fitch said her office will continue to pursue actions against pharmacy benefit managers, or PBMs, that she says take advantage of consumers and undermine access to care.
