A local tow truck driver has been charged with two separate DUIs while responding to calls to tow a vehicle, one of the calls was a DUI arrest.
According to arrest reports filed with the Picayune Police Department, 50-year-old Don Osbourn of 3624 Mississippi Highway 43 North, was called by the department to help tow two vehicles involved in an accident on Thursday, March 14.
The reports state Osbourn arrived at the accident scene at the intersection of U.S. Highway 11 and Miss. 43N just after 3 p.m., at which time the officer on scene detected the odor of intoxicating beverage coming from his person. The officer also noticed Osbourn to be unsteady on his feet as they talked, the report states.
He was asked if he had consumed any alcohol or taken any medication, to which he replied one drink an hour ago at a local bar and a prescription medication pill, Hydrocodone, the report states. When the officer asked if Osbourn thought he should be driving, he admitted he didn’t think he should be, the report states.
A field sobriety test was conducted, but he refused to consent to blood test, leading to Osbourn being charged with DUI refused test, the report states.
Osbourn was also arrested on Nov. 2, 2012 while responding to a call in the county from the Pearl River County Sheriff’s Department, said Chief Investigator Donnie Saucier. Deputies working a DUI traffic stop called Osbourn out to tow the suspect’s vehicle just after 1 a.m., but when Osbourn arrived, the deputy could smell alcohol on his person and breath, Saucier said.
Osbourn consented to a portable breath test, which showed positive for the presence of alcohol, but he refused to submit to a field sobriety test, Saucier said. Osbourn was taken into custody by the deputy for DUI, Saucier said. During booking Osbourn refused to submit to a breathalyzer test, Saucier said.
After Osbourn’s arrest, the deputy on scene had to call another wrecker to tow the first vehicle and a larger tow truck to tow Osbourn’s wrecker, Saucier said.
